Our basic principles:
  • We process only necessary personal data when you are visiting the site and using the Beenia application.
  • We can perform other processing for you only if you ask us to do so.
  • Your personal and work data is confidential to us.
  • We monitor all access to the application.
  • We can always verify that this is not unauthorized access.
  • When processing personal data, we follow all valid legislation of the Slovak Republic and the EU

The Controller ensures the protection of personal data in accordance with the requirements of:
  • GDPR (General Data Protection Regulation) - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation). Valid from 25.5.2018 and effective from 25.5.2018
  • Act no. 18/2018 Coll. on Personal Data Protection and on Amendments to Certain Acts (hereinafter referred to as the “Act”). Effective May 25, 2018

A data controller determines the purposes and ways that personal data is processed, while a data processor is a party that processes data on behalf of the controller.

Privacy Policy

As you use the Beenia application and interact with the Beenia Websites (collectively, the "Services"), Beenia collects and processes information from and about you in order to provide you with access to the Services, enhance your experience while using the Services, and interact with you.

This Privacy Policy (the “Policy”) describes how Beenia collects, uses, and discloses information collected through the Services, and what choices you have with respect to such information.

The first section below explains which privacy terms are applicable to you depending on what type of user you are.

1. Types of users / The data subject:
  • Subscribers - Users of paid services of the Beenia application. We call users who have access to the Beenia application as part of any tier of a paid Beenia subscription plan “Subscribers.”
  • Customers - natural or legal person ordering Beenia services (payers of services) The Service features and functionalities available to Subscribers are determined by the specific terms agreed to between GLOBESY, Ltd. and the organization (e.g., your employer or another entity or person, called the „Customer“) that entered into a separate agreement that governs delivery, access, and use of the Services. (for the purpose of this Policy, the “Customer Agreement”). Further information on this agreement or contract can be found on our website: BEENIA Terms of Use.com.Please note:In this case, the Customer is the one who determines the purpose and ways that personal data is processed, and therefore the Customer is (within the meaning of GDPR) the controller of the Subscribers’ personal data and Beenia is only the processor which processes personal data on behalf of the Customer.
  • Free Users - users who use a non-paid version of the Beenia application
    While Free Users can access and use the Service, they have access to a more limited set of Service features and functionality than Subscribers.
    Beenia is the data controller of the personal data collected through the Services about Free Users.
    Please note: Free Users are subject to the same privacy terms as Subscribers, please see this section below.
  • Site Visitors beenia.com - users of the websites beenia.com. Site Visitors can be individuals who are simply browsing the Websites but who do not use the Asana Service; or, Site Visitors can be Free Users or Subscribers who visit the Websites to seek additional information about Asana. Asana is the data controller of the information collected through the Website about Site Visitors.
  • Future Users of Beenia (hereinafter referred to as "Future Users") Future users are people invited to Beenia by Free Users or Subscribers.
  • Other affected persons and potential clients (hereinafter referred to as "Other Persons")
    Other persons are contact persons known from our business communication, meetings, or from completed questionnaires, business forms, etc.
2. Privacy Terms for Subscribers and Customers including Free users:

If you are a Subscriber, the “Customer Agreement” governs the collection and processing of personal data collected from you as a Subscriber.

The Customer controls the Workspace used by Subscribers in the Beenia application, if you have any questions about the Customer’s specific Workspace settings and privacy practices, please contact the Customer whose Workspace you use.

In the event of a conflict between this Privacy Policy and the Customer Agreement, the Customer Agreement governs.

Please note: When processing Workspace Content governed by the Customer Agreement, Beenia is the data processor, meaning that we collect and process such information solely on behalf of the Customer.

2.1 Collection and Use of Subscriber Information:

We do not require Subscribers to provide us with information. However, certain information, such as account log-in data, is required to provide you with access to the Beenia application, and other information may be collected automatically as you use the Services - as set forth in: Common Privacy Terms for all data subjects:

Workspace Content

Beenia does not normally process the content of the workspace, only if on the basis of the Customer's instructions and in accordance with the Customer Agreement, or in accordance with the valid laws of the Slovak Republic and the EU.

The Customer, and not Beenia, determines its own, internal policies regarding storage, access, modification, deletion, sharing, and retention of Workspace Content which may apply to your use of the Beenia application.

Please check with the Customer about the policies and settings that they have instituted with respect the Workspace Content that you provide when using the Beenia application.

The content of the workspace can be, for example, the following personal data recorded by the Subscriber:

  • telephone number / mobile phone, address of residence,
  • profile photography, or other embedded photos
  • job position, job classification, etc.
  • personal data of his or her colleagues, employees, customers, etc.,
  • personal data in the application data - in the name of the activity, description of the activity, comments, etc.
  • personal data contained in files that Subscribers have uploaded as attachments to the Beenia application, e.g. in attached photographs, documents, videos, etc. ...

Purpose of processing:

  • Fulfilment of the Customer Agreement;

Beenia may only view the contents of the workspace in justified cases (purposes):

  • If necessary, to solve technical or safety problems;
  • In the case of a request from the Subscriber or from the Customer for support;
  • In the event of a suspicion or complaint that the content violates the Customer Agreement;
  • To adapt the application on a continual basis to the needs of users - to ensure a user-friendly application environment (upgrades and innovations)

Account Information

To create a Customer account in the Beenia application, it is necessary to provide login details:

  • forename, surname, or title and working position
  • email address,
  • Login name and password

These login details are provided by either the Subscriber himself/herself or the Customer.

Purpose of processing:

  • Providing Beenia application services;

Legal basis of processing: performance of a contract (letter (b) of paragraph 1 of Article 6 of the GDPR,)

2.2 Collection and Use of Customers' Personal Data:

Processing of the Customer's personal data is necessary for bookkeeping and tax obligations of the operator Services (GLOBESY, Ltd.), especially in accordance with the laws:

  • Act no. 431/2002 Coll. on accounting, §35
  • Act no. 222/2004 Coll. on VAT, §76 - storage of invoices
  • Act no. 395/2002 Coll. on archives and registries, §16
  • Act no. 211/2000 Coll. on free access to information
  • Act no. 222/2004 Coll. on VAT, §70 - record keeping
  • Act no. 595/2003 Coll. on income tax; §19, §41

Customer’s Data List – Customer’s personal data that may be subject to processing:

Billing / payment information

If a card payment is made in connection with the use of the Beenia application, then such an operation is processed by a third-party payment gateway and we do not store credit card numbers! The third-party service provider, and not Beenia, stores your payment information on our behalf.

If payment for Beenia services is made in a form other than card payment, Beenia may process the following personal data:

  • invoicing data of the Customer
  • personal data of contact persons responsible for invoicing Beenia services (name, surname, title, email, telephone, job position)

Purpose of processing:

  • Invoicing - payment for the use of Beenia services;

Legal basis of processing: compliance with a legal obligation (letter (c) of paragraph 1 of Article 6 of the GDPR,)

Contractual data

The content of the Customer Agreement and any personal data of persons contained in this Agreement may only be processed for the purposes of:

  • Fulfilment of the Customer Agreement;

Legal basis of processing: performance of a contract (letter (b) of paragraph 1 of Article 6 of the GDPR,)

  • Document archiving;

Legal basis of processing: compliance with a legal obligation (letter (c) of paragraph 1 of Article 6 of the GDPR,)

3. Common Privacy Terms for all data subjects except Future Users:

Below is a list of personal data that may be processed for specific purposes by all data subjects, with the exception of Future Users.

List of personal data processed by all data subjects:

Contact details and details of mutual communication
  • forename, surname, title (if provided);
  • email address,
  • telephone number (if provided)
  • key information from mutual communication, or communication content (if relevant)

The contact details of the data subjects may be processed for the purposes of:

  • communication with the data subject;

It means routine communication with the data subject, in particular to provide information and answers to questions, to solve problems, to provide support, to perform system maintenance, in building new business opportunities, by means of a contact form, e-mail communication or other written form of communication, or through a personal or telephone conversation.

Legal basis of processing: legitimate interests (letter (f) of paragraph 1 of Article 6 of the GDPR,)

  • marketing activities (promotional communication)

It means carrying out activities in order to maintain business relations and build new business opportunities. It means:

  • occasional sending of offers, information and materials about products, solutions and services;

„Newsletter Services“

  • occasional sending of important announcements and information about important events;

„Newsletter Announcements“

  • occasional Sending of marketing items (e.g. New Year's greetings and promotional gifts);

Legal basis for the processing of contact details of Subscribers, Customers and Free Users: legitimate interest (letter f) para. 1 of Article 6 of the GDPR + in accordance with point 47 of the preamble to the GDPR: processing of personal data for the purposes of direct marketing and according to § 62 par. 3) of Act no. 351/2011 Coll. on electronic communications)

The data subject can unsubscribe from these marketing activities at any time by clicking on the unsubscribe link in any of our e-mail messages, or by sending a unsubscribe request directly privacy@beenia.com .

Legal basis for the processing of contact details of Site Visitors and Other Persons: consent of the data subject (letter (a) of paragraph 1 of Article 6 of the GDPR,)

The data subject may withdraw his or her consent at any time, simply and free of charge, by sending a brief Request for Withdrawal of Consent to privacy@beenia.com, or by clicking on the opt-out link in any of our email messages.

Information from Beenia questionnaires and business forms:

The data subjects may, of their own free will, provide to Beenia other important information:

  • answers to questions provided in the questionnaires or forms;

If the questionnaire or form is not anonymous, the data subjects may further provide some or all of the following personal data:

  • name, surname, title, job position, employer;

References to our services and / or the Beenia application

The data subjects may, of their own free will, provide to Beenia:

The reference provided in this way by the person concerned may subsequently be published on our website with his or her consent.

What are Cookies?

To improve your browsing quality of www.beenia.com website and use of the Beenia application, we use small data files called cookies, which we place on your device (computer, mobile phone, etc.) when you visit our website.

Cookies help you to remember your activities and preferences for a certain period of time, so that you do not have to save them again when you return to the site or go from page to page. The information is used for the purpose of optimising the services provided through this website, including sub-pages and links.

This means that we use cookies to improve the quality of our site:

4. Privacy Terms for the Future Users:

Users of Beenia (Subscribers), through their user account, can send an invitation to the Beenia application to their colleagues, employees, or any other person to register for the Beenia application - to potential Future Users of Beenia Application.

Future user’s Data List

To send the invitation, it is necessary to process the personal data of the invited person as a potential Future User:

  • Contact personal data of the Future User:
  • forename, surname
  • Email address
  • Title (if provided)

Notice: This personal data may be filled in by the inviting Subscriber only in the invitation with the prior consent of the Future User. The Subscriber is responsible for this consent.

Purpose of processing:

  • Inviting of new users to the Beenia application (via e-invitation)

(Gaining new business opportunities)

Legal basis of processing: legitimate interests (letter (f) of paragraph 1 of Article 6 of the GDPR,)

5. Other common conditions for the protection of personal data for all data subjects:
Notice to all data subjects:

Any personal data of the data subjects may also be processed for the purpose of fulfiling the legal requirements of the control authorities of the Slovak Republic;

The recipients or categories of recipients:

The recipients of the above-mentioned personal data of the data subjects may be:

  • Beenia employees - mainly administrators, programmers, technicians, accountants,
  • State authorities - in case of a legal requirement
Transfer to third countries or international organizations:

AWS Services is operated by Amazon.com, Inc., headquartered in Seattle, Washington, USA, which is listed among companies operating under Privacy Shield framework.

This means that according to Art. 45 EU regulations involve transfers to countries guaranteeing an adequate level of protection, and no special authorisation is required for such transfers - the European Commission has decided on the adequacy for the United States under Directive 95/46/EC.

The period for which the personal data will be stored:
  • within 3 years from the last visit to www.beenia.com - valid for Site visitors
  • within 3 years from the last communication with the affected person - applies to Other persons
  • within 5 years from the last activity in the Beenia application - applies to Subscribers

(applies only to personal data that are not processed on the basis of the performance of the Customer Agreement)

  • within 3 months of sending the invitation to register in the Beenia application - applies to Future Users of the Beenia application who have not registered in the application;
  • within 10 years from the termination of the contractual relationship - applies to Customers
  • Data processed on the basis of the granted consent will be processed exclusively for the period for which the consent was granted, resp. until his appeal.

Please note: The so-called "Website visitor session", the data of visitors to the website www.beenia.com (automatically stored data on the use of the website and the IP address), are stored for a short time in the so-called log filesthat are automatically deleted and no longer stored.

Rights of data subjects:

The data subject may exercise the following rights against the processing of his/her personal data for the above purposes:

  • Right of access to personal data,
  • Right to rectification of inaccurate personal data,
  • Right to erasure personal data (‘right to be forgotten’),
  • Right to restriction of processing,
  • Right to be informed of the rectification, erasure or restriction of the processing of personal data;
  • Right to object to the processing of personal data

(applicable only if the processing is performed on the basis of the legitimate interest of Beenia)

  • Right to withdraw consent

  • Right to file a complaint to the supervisory body - the Office for Personal Data Protection of the Slovak Republic
  • Right to submit a proposal to the supervisory authority to initiate proceedings on the protection of personal data

The data subjects may exercise their rights by sending their Application for Exercise of Rights to the e-mail address privacy@beenia.com, or to the correspondence address provided on the Beenia website: www.beenia.com.

6. Final provisions:

Use of the Beenia application is governed by the general terms and conditions, which can be found at:  www.beenia.com/obchodné podmienky.

Beenia reserves the right to amend this privacy policy in accordance with current legislation. The Data subjects will be notified of the update of this policy by means of a notice on the website www.beenia.com and in the Beenia application.
